Análisis de la Ley No. 118 "Ley de la Inversión Extranjera" en Cuba y propuesta de modificación para incrementar la oferta turística

Abstract

RESUMEN: El turismo constituye un pilar fundamental dentro de la economía cubana, como fuente generadora de altos ingresos, que se ha ido desarrollando fuertemente en el país a lo largo de los últimos años por medio de la inversión extranjera, en especial a partir de las modificaciones introducidas por la Ley No. 118 ´´Ley de la Inversión Extranjera´´ en Cuba, a mediados de 2014, con especial impacto en la actividad hotelera. Esta Ley, demuestra la existencia de un problema real del sistema económico y jurídico cubano, el cual muestra grandes deficiencias desde el punto de vista normativo en cuanto a la regulación de las inversiones extranjeras en el país, pues su regulación es muy restrictiva y cerrada, al mismo tiempo que se deja de lado la inversión de capital privado, y no existen suficientes garantías y certidumbre jurídica para los inversionistas que deseen establecer negocios en la Isla; lo cual repercute fuertemente en el turismo al ser este un sector que se alimenta y se desarrolla fundamentalmente por medio de los capitales foráneos. En el presente trabajo, se aborda un análisis, crítica y estudio profundo de la mencionada ´´Ley de la Inversión Extranjera´´ en Cuba y de cada uno de los elementos y figuras jurídicas que la componen para determinar sus principales dificultades en la regulación de las inversiones extranjeras en el país y en especial de aquella dirigidas a al sector turístico . De manera complementaria al estudio de la norma, se realizó también, un estudio de la situación y comportamiento de las inversiones de capitales foráneos dentro del sector turístico en el país y de cómo este ha repercutido en el desarrollo de tan importante sector para la economía cubana, como su principal fuente recaudadora de divisas. Derivado de los resultados obtenidos por medio de los estudios realizados, se estableció una propuesta de perfeccionamiento de algunos de los preceptos jurídicos fundamentales de la Ley No. 118 cubana, los cuales permitirán flexibilizar el sistema inversionista en el país y en especial contribuirán a encaminar un auge en las inversiones foráneas en el sector turístico de la Isla, las cuales permitan el desarrollo de la actividad turística y la diversificación de la oferta del sector en la Isla.

ABSTRACT: Tourism constitutes a fundamental pillar within the Cuban economy, as a source of highincome generation, which has been developing strongly in the country in recent years through foreign investment, especially after the modifications introduced. by Law No. 118 ´´Law on Foreign Investment´´ in Cuba, in mid-2014, with special impact on hotel activity. This Law demonstrates the existence of a real problem of the Cuban economic and legal system, which shows great deficiencies from the normative point of view regarding the regulation of foreign investments in the country, since its regulation is very restrictive and closed, at the same time that private capital investment is left aside, and there are not enough guarantees and legal certainty for investors who wish to establish businesses on the Island; which has a strong impact on tourism as this is a sector that is fed and develops mainly by means of foreign capital. In the present work, an analysis, criticism, and in-depth study of the aforementioned ´´Law of Foreign Investment in Cuba´´ and each of the elements and legal figures that compose it to determine its main difficulties in the regulation of foreign investments in the country and especially those directed to the leisure and hospitality industry. Complementary to the study of the norm, a study was also carried out of the situation and behavior of foreign capital investments within the tourism sector in the country and how this has had an impact on the development of such an important sector for the Cuban economy, as its main source of foreign exchange. Derived from the results obtained through the studies carried out, a proposal was made for the improvement of some of the fundamental elements of Cuban Law No. 118, which will make the investment system in the country more flexible and will contribute to achieving or directing a boom in foreign investments in the island's tourism sector, which allow the development of tourism activity and the diversification of the sector's offer on the island.
